The Supreme Court has declined to take up an appeal from President Donald Trump over a $5 million verdict and finding that he sexually abused and defamed E. Jean Carroll, a decision that means the president will now have to pay the magazine columnist.

Carroll sued Trump in 2019 for defamation and then she sued him again in 2022 for defamation and battery after New York enacted a law allowing the victims of sexual abuse to file civil claims for past incidents. In an unusual quirk, the second case — the one filed in 2022 — went to trial first and the jury awarded Carroll $5 million. That is the case the Supreme Court agreed to hear.

The 2019 case went to trial second and resulted in an $83 million judgment against Trump. Including interest, Trump owes Carroll over $100 million in all.

In a divided 6-3 decision, the court ruled that the executive order Trump issued on January 20, 2025, was unlawful. Associate Justice of the Supreme Court, #BrettKavanaugh, said the order violated federal law but not the Constitution. However, five justices stated that the order violated the Constitution’s 14th Amendment, which has been interpreted to grant birthright citizenship to nearly everyone born in the United States.

Under Trump’s proposal, birthright citizenship would have been restricted to those who have at least one parent who is a U.S. citizen or permanent resident. Babies born to temporary visitors or individuals who entered the country illegally would not have been granted citizenship at birth.     3    A study by Duke University Press found that ending birthright citizenship could result in an increase of 2.5 million undocumented residents, disproportionately impacting Latine populations. It also estimates that by 2050, the unauthorized Latine population could grow by nearly 30%.

Two months after Jess Silva filed for divorce, she learned she was pregnant. Her friends, part of a group chat called Bebes, rallied around her and tried to help her figure out her options. A month after the divorce was finalized, Jess’s ex-husband filed a wrongful death lawsuit against two of her friends. Using photos taken of exchanges in the Bebes text thread as evidence, he sought $2,000,000 in damages over Jess’s alleged abortion. 
 
Between 2000 and 2020, @ifwhenhow, a nonprofit dedicated to reproductive justice, found 61 cases of individuals “criminally investigated or arrested for allegedly ending their own pregnancy or helping someone else do so.” The risk of sharing information about an abortion is clear: 26 percent of the cases came to the attention of law enforcement because an intimate acquaintance—a friend, parent, or partner—reported the pregnant person to authorities. Many of the cases involved people who’d self-managed their own abortion, usually by ordering pills online, but over a quarter of cases were centered on people investigated or arrested for helping someone else.

Chief Justice John Roberts wrote the majority opinion, calling citizenship “the right to have rights.” The court ruled 6-3 that states can ban transgender athletes from girls' and women's sports. Justice Kavanaugh wrote the majority. Then came conflicting reports. NPR mistakenly reported today that Justice Samuel Alito was retiring. The Supreme Court's public information office quickly denied it, saying no such announcement had been made. NPR then retracted the story. Kalshi traders give a 47% chance Justice Alito retires from the Supreme Court before the beginning of 2027.

James Wilson was arguably the most influential, prescient, and democratic drafter of the Constitution—but despite this, the Scottish American lawyer who would eventually sit on the Supreme Court died a pariah, Jesse Wegman argues. Wilson spoke more than all but one of his fellow delegates at the 1787 Constitutional Convention. From the start, his guiding principle was the power of regular people, whom he saw as “the legitimate source of all authority.” Wilson declared that “the general government is not an assemblage of states, but of individuals,” adding that individuals, “not the States, ought to be represented in it.” But to many of Wilson’s fellow delegates, “this was unconscionable,” Wegman writes. When Wilson died, in August 1798, he had been holed up in a sparsely furnished boarding room for nearly a year while avoiding creditors, to whom he owed unspeakable debts from land speculation. There was no public announcement of his death. “It was an ignominious end to a man who was not only a Supreme Court justice” but also one of only six men to sign both the Constitution and the Declaration of Independence, Wegman writes. Wilson, unlike the other Founders, had no acolytes who promoted his legacy and preserved his record. This “kept him out of history books as the conventional narrative of the founding took shape,” Wilson continues. But 250 years since the signing of the Declaration of Independence, “recovering his role in creating America is essential if the nation is to recommit itself to the ideals of democracy and popular sovereignty, which he championed with greater force than any of his contemporaries did.” 📷: The Atlantic.
