In a divided 6-3 decision, the court ruled that the executive order Trump issued on January 20, 2025, was unlawful. Associate Justice of the Supreme Court, #BrettKavanaugh, said the order violated federal law but not the Constitution. However, five justices stated that the order violated the Constitution’s 14th Amendment, which has been interpreted to grant birthright citizenship to nearly everyone born in the United States.

Under Trump’s proposal, birthright citizenship would have been restricted to those who have at least one parent who is a U.S. citizen or permanent resident. Babies born to temporary visitors or individuals who entered the country illegally would not have been granted citizenship at birth.
